Terms of sale

Page under review: the parts in square brackets will be completed by the operator and its lawyer before the shop opens.

Version 0.2 of 31 October 2026, under review. These terms govern purchases on the Tulvano shop. You read them before creating an account and again before confirming an order; the version in force when you place an order is the one that applies to that order.

1. Who sells

The seller is Lelio Pellegrini, sole proprietorship (impresa individuale), seated at Piazzale Brescia 16, 20149 Milan (MI), Italy, VAT number 05422890961, entered in the register of companies of Milano Monza Brianza Lodi under REA number MI-2550187 (the "Seller"). The full details are in the legal information. The Seller sells the products of the catalogue in its own name: the contract of sale is concluded with the Seller, also when a product is supplied to the Seller by a third party.

2. Whom we sell to, and the declaration at the order

The shop sells to businesses and professionals and to consumers. Before confirming the order you declare whether you buy as a business or professional (giving your VAT number) or as a consumer, that is for purposes outside your trade, business, craft or profession. The declaration determines the content of the invoice, how VAT is shown to you and whether the right of withdrawal described in point 8 is yours. An untrue declaration is at your charge.

3. Catalogue, prices and availability

Prices are in euro. In the catalogue every price states whether it includes VAT and at which rate; before you confirm the order you see the total, the VAT and the delivery costs, separately (Article 7(1)(h) of Legislative Decree no. 70 of 9 April 2003). The availability shown in the catalogue is refreshed periodically by the suppliers and is indicative: it is checked at the confirmation of the order, as described in point 4. The Seller corrects manifest errors of price or description and, if the error concerns an order already confirmed, tells you and lets you choose between confirming at the correct price and cancelling at no cost.

4. How the contract is concluded

  • The cart becomes an order only when, having seen the total, the VAT and the delivery, you press the confirmation button. No order is created automatically, by a connected system or by a procedure.
  • You receive by e-mail the acknowledgement of the order, with the summary of the lines, the prices and the delivery address.
  • The Seller checks availability and accepts the order, or declines it if a product is not available, within [OWNER: confirmation window, in working days] of receipt. The contract is concluded on acceptance. If the order is declined, nothing is charged to you and anything already paid is returned by the same means.
  • You may cancel an order until it has been accepted, from the order's page in your account.

5. Payment

[LAWYER: accepted means of payment and the moment of the charge, to be written with decision B on the payment provider]. No payment is requested or charged until this section is complete.

6. Delivery

The delivery times stated in each product's offer are estimates and run from the acceptance of the order. Delivery costs are shown to you before confirmation. An order may be delivered in more than one shipment; we tell you, and you pay no additional delivery cost for it. [LAWYER: passing of risk and inspection on delivery, distinguishing consumers and businesses].

7. Invoice

For every accepted order the Seller issues the invoice, in electronic form through the Sistema di Interscambio where the law requires it, with the details you declared in point 2. A copy is available in your account. A credit note, where due, is a separate document: an issued invoice is never altered.

8. Right of withdrawal (consumers only)

If you buy as a consumer you have the right to withdraw from the contract without giving a reason, under Articles 52 et seq. of the Italian Consumer Code (Legislative Decree no. 206 of 6 September 2005), subject to the exceptions the same law provides, among them goods made to measure or personalised. [LAWYER: period, form of the notice, model form, return costs and applicable exceptions, from the text of Articles 52-59 stored in laws/it/dlgs-206-2005.md]. Until this section is complete, the shop accepts no orders from consumers.

If you buy as a business or professional, the right of withdrawal does not apply (Article 3(1)(a) of the Consumer Code, which defines the consumer).

9. Warranties

If you buy as a consumer, the products are covered by the legal guarantee of conformity of Articles 128 et seq. of the Consumer Code. If you buy as a business or professional, the warranties of the Civil Code on sale apply (Articles 1490 et seq.). [LAWYER: duration and notice periods for each case, and the relation to the manufacturer's warranty]. The manufacturer's documents (data sheets, declarations of conformity, markings) published on the product sheet are part of the description of the goods.

10. Use of the products

The products of the catalogue are material for installations and building. Their installation must be carried out by qualified persons and according to the technical standards and the manufacturer's instructions. The Seller answers for the conformity of the product to its sheet, not for an installation or a use that departs from them.

11. Account

The account is personal. Keep your credentials safe and turn the second factor on if you wish; what happens with your credentials is attributable to you until you report a misuse. The Seller may suspend an account used for fraudulent activity or against these terms, telling you so. You may close the account at any time from "Your account"; concluded orders and invoices are kept for the time stated in the privacy notice.

12. Governing law and jurisdiction

Sales are governed by Italian law. If you buy as a consumer, disputes go before the court of the place where you reside or have elected domicile (Article 66-bis of the Consumer Code); [LAWYER: confirm the citation and complete with the applicable out-of-court dispute resolution means]. If you buy as a business or professional, the courts of Milan have exclusive jurisdiction.

13. Changes

The Seller may change these terms; the updated version is published on this page with its date. An order is governed by the version you accepted when confirming it.
